These Terms of Service ("Terms") govern your access to and use of the website and services provided by Pixel Perspective LLC ("we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.
Pixel Perspective provides growth marketing services to health & wellness e-commerce brands, including but not limited to: creative strategy, ad creative production, Meta Ads management, revenue operations consulting, and related marketing services. The specific scope of services for each client is defined in a separate Master Service Agreement (MSA) or Statement of Work (SOW).
You must be at least 18 years old and have the legal authority to enter into a binding agreement to use our services. By engaging our services, you represent that you meet these requirements.
Submitting an application through our qualification form does not guarantee acceptance as a client. We reserve the right to accept or decline any prospective client at our sole discretion. We work with a limited number of brands per quarter to ensure quality of service.
All client engagements are governed by a separate Master Service Agreement (MSA) that outlines:
In the event of a conflict between these Terms and a signed MSA, the MSA shall prevail.
Payments are processed through Stripe and/or Whop. By providing payment information, you authorize us to charge the agreed-upon fees according to the schedule outlined in your MSA. All fees are in US dollars unless otherwise specified.
All payments for services rendered are non-refundable. For our complete refund policy, please see our Refund Policy.
Our IP: All proprietary methodologies, frameworks, systems, templates, and processes developed by Pixel Perspective remain our intellectual property. This includes but is not limited to our creative testing system, audience research frameworks, and analytical tools.
Client IP: All creative assets, ad copy, and deliverables produced specifically for a client's brand become the client's intellectual property upon full payment, unless otherwise specified in the MSA.
Portfolio rights: We reserve the right to use anonymized case studies, aggregated performance data, and general descriptions of work performed for portfolio and marketing purposes, unless explicitly restricted in the MSA.
We treat all client business information, ad account data, performance metrics, and strategic insights as confidential. We will not disclose client-specific information to third parties without consent, except as required by law or as necessary to provide our services (e.g., sharing with authorized platform tools).
You agree not to:
Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee specific results, revenue increases, CPA reductions, or other performance outcomes. Past performance and case studies are not guarantees of future results. Marketing results depend on numerous factors beyond our control, including but not limited to: product quality, market conditions, platform algorithm changes, and client cooperation.
To the maximum extent permitted by law, Pixel Perspective LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of our website or services. Our total liability shall not exceed the total fees paid by you in the three (3) months preceding the claim.
You agree to indemnify and hold harmless Pixel Perspective LLC, its owner, and its contractors from any claims, damages, losses, or expenses arising from your breach of these Terms or your use of our services.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Sheridan County, Wyoming.
We reserve the right to terminate or suspend access to our website or services at any time, without notice, for conduct that we believe violates these Terms or is harmful to our business or other users.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
